Liability for Dog Bites in Texas

In Texas, the law regarding dog bites is based on a combination of the "one bite rule" and negligence. The "one bite rule" states that a dog owner is liable for injuries caused by their dog if they knew or should have known that the dog had a history of biting or aggressive behavior. This means that if a dog has bitten someone before or displayed aggression, the owner can be held responsible for any subsequent bites.

In addition to the "one bite rule," Texas also recognizes negligence as a basis for liability. If a dog owner fails to take reasonable care to prevent their dog from biting someone, they can be held liable for the resulting injuries. This could include failing to properly restrain or control their dog, or not warning others about the dog's dangerous propensities.

Consequences of Dog Attacks

Aside from the consequences mentioned earlier, dog bites can result in puncture wounds and lacerations, nerve damage, muscle injuries, broken or crushed bones, and broken teeth (from falling due to a dog attack), and can even lead to life-threatening complications, such as sepsis or blood loss. 

Which Breeds Are the MosT Dangerous?

As the CDC warns, any dog, even those considered to be docile, can bite. However, certain breeds are more responsible for dog bite attacks than others. These include pit bulls, Rottweilers, and German Shepards. Pit bulls include a variety of breeds; they were responsible for 33 of 46 dog bite fatalities in 2019. Those injured by pit bulls generally have a greater risk of increased injuries, medical expenses, and death than dog bite victims of other breeds.
